RECENT MATTERS INCLUDE:

Successfully representing former chief technology officer of a privately-held company in a dispute with former shareholders. We convinced the federal court to dismiss the lawsuit against our client with prejudice and, on appeal, persuaded the Ninth Circuit to award our client attorneys’ fees.

Successfully representing Company and its Founder in dispute with minority shareholders.

Successfully representing a large, privately-held employment staffing firm in a shareholder class action arising from its merger with publicly traded corporation.

Successfully representing former hedge fund investors in litigation related to the Bernie Madoff Ponzi scheme. We obtained a confidential settlement with the investors’ former investment adviser.

Representing former customer of investment advisory firm in dispute with the firm and brokerage firm.

COMPLEX COMMERCIAL LITIGATION

Murphy Cooke lawyers also routinely litigate matters involving breach of contract claims, trade secret disputes, privacy violations and security disputes and unfair competition claims.

RECENT ENGAGEMENTS INCLUDE:

• Represented a defendant in the Silicon Valley “Voice Mail” trade secrets case, Jasmine Networks v. Marvell Semiconductor. We persuaded the plaintiff to voluntarily dismiss our client on the eve of trial without our client having to pay anything to settle $300 million claim.
• Represented an auto and industrial parts manufacturer in a series of seven cases against competitors for raiding employees and stealing trade secrets. Obtained favorable settlements to prevent unfair competition against the client.
• Defended two former employees of a company against the company’s claims of trade secret misappropriation for trying to license software that they themselves wrote. Resulted in a settlement by which the clients retained ownership of the software and the company’s claims against the employees were dismissed.
